1. Acceptance of Terms

By accessing or using Protocol (the "Service"), including the Protocol mobile application and the protocolapp.co website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Protocol is a podcast learning application that helps users retain information through reflection prompts and AI-generated quizzes. The Service includes browsing podcast episodes, writing reflections, taking quizzes, and viewing learning statistics.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as needed.

You must be at least 13 years of age to create an account and use the Service.

4. Payment Terms

Protocol offers a free tier and a paid Premium subscription. Premium subscriptions are billed monthly at the rate displayed at the time of purchase. Payments are processed through Stripe.

You may cancel your Premium subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

We reserve the right to change subscription pricing with at least 30 days notice. Price changes will apply to the next billing cycle following the notice period.

5. User Content

You retain ownership of any content you create through the Service, including reflections and other text you write. By using the Service, you grant Protocol a limited license to store, process, and display your content as necessary to provide the Service.

You agree not to submit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.

6. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Protocol and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written consent.

Quiz questions generated by the Service are created using AI and are provided for your personal educational use. Podcast content accessible through Protocol remains the property of the respective podcast creators and publishers.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Interfere with or disrupt the Service or servers connected to the Service.
• Use automated means (bots, scrapers, etc.) to access the Service without permission.
• Resell, redistribute, or commercially exploit the Service or its content.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through the app settings.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Quiz questions are generated by artificial intelligence and may occasionally contain inaccuracies. Protocol does not guarantee the accuracy or completeness of AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Protocol and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
